0) Overview

Welcome to Nethergate Brewery. When we say “Nethergate”, “we”, “us”, “our”, we mean Nethergate Brewery Co Ltd. We run this website and shop (the “Services”) to bring you our beers, spirits, and good times. The Services are powered by Shopify, which helps us operate the store.

These Terms of Service (the “Terms”), together with any policies we link to (including our Privacy Policy [LINK] and Refunds & Returns Policy [LINK]), set out how things work when you browse, buy, or otherwise use the Services. By using the Services, you agree to these Terms. If you don’t agree, please don’t use the Services.

2) Age Restriction (Alcohol Sales)

We only sell alcohol to people of lawful drinking age in their country. By placing an order, you confirm you’re old enough—and, if it’s a gift, that the recipient is too. Couriers may ask for valid photo ID on delivery. If there’s doubt, no delivery. Responsibility for age verification sits with the purchaser.


3) Access & Accounts

You may browse without an account, but some features require one. Please keep your login details safe—you’re responsible for all activity on your account. Information you provide (name, email, billing/shipping, payment) must be accurate and kept up to date.


4) Our Products (Descriptions & Availability)

We do our best to describe products accurately. Colours and appearance can vary by screen and settings. Products, prices, and descriptions can change without notice. We may limit quantities per person, household, or order, and we may discontinue products at any time.


5) Orders & Our Contract With You

When you place an order, that’s an offer to buy. We’ll acknowledge receipt by email (“Order Received”), but your order is only accepted when we send a Dispatch Confirmation email. The contract covers only the items listed in that Dispatch Confirmation. If we can’t accept your order (for example, stock or payment issues), we’ll let you know and refund any payment taken for the affected items.


6) Prices, Taxes & Billing

Prices are shown on the product pages and at checkout. Unless stated otherwise, UK prices include VAT. Delivery, duties, and import charges (if applicable) are shown or advised at checkout but may vary by destination. Promotions can change without notice and may have additional terms.

You agree to provide current, complete, and accurate payment details. You authorise us (via our payment provider Stripe) to charge the total amount shown at checkout. If your card issuer declines payment, we can’t process your order.


7) International Orders, Duties & Import

If you order from outside the UK, you may be responsible for local import taxes, duties, and fees. These are set by your local authority and are out of our hands. Customs processes can delay delivery—we’re not liable for such delays.

Current shipping destinations may include (but aren’t limited to): Belgium, Bulgaria, Czech Republic, Denmark, Estonia, France, Germany, Ireland, Latvia, Lithuania, Luxembourg, Netherlands, Norway, Sweden, Spain, Portugal, Romania, Slovenia, Switzerland, and the UK. Availability can change.


8) Shipping, Delivery & Risk

We dispatch Monday–Friday (excluding public holidays). Delivery windows are estimates, not guarantees. Once we hand your parcel to the courier, title and risk pass to you.

If no one is available to sign and the courier leaves a contact card, please rearrange delivery promptly. Unclaimed parcels may be returned to us; we can refund the product price minus initial delivery and any return charges, or re-send for an additional delivery fee.


9) Cancellations, Returns & Refunds

Cooling-off (UK/EU): You have 14 days from the day after delivery to cancel, provided items are unused and in their original packaging. Return postage and risk are yours (unless the item is faulty). Once received and inspected, we’ll refund the product price and the standard delivery cost (where applicable).

Our goodwill policy: We also offer a 30-day returns window—see our full Refunds & Returns Policy [LINK] for details, including what can/can’t be returned, and how to start a return. Please don’t send items back without contacting us first; we’ll provide instructions and a label if applicable.

Damages & shortages: Inspect on delivery; if anything’s wrong, tell the courier (where possible) and email shop@nethergate.co.uk within 3 working days with your order number and clear photos. If verified, we’ll arrange a replacement or refund. If a like-for-like item is unavailable (e.g., one-offs), we’ll refund the item and any applicable original shipping. No additional compensation is payable.


10) Gift Cards, Vouchers & Membership Perks

Gift cards and vouchers may be non-refundable, non-transferable for cash, and time-limited—see the specific terms on your voucher or the product page. Membership-related vouchers (e.g., tour vouchers) typically carry a validity period (e.g., 12 months)—please check the details provided at purchase.


11) Purchase Limits & Fair Use

To keep things fair, we may set purchase limits on certain releases (including one case per customer/household). If we detect multiple orders exceeding stated limits, we may cancel or adjust them and refund accordingly.


12) Optional Tools & Third-Party Links

From time to time we may offer tools or links from third parties. We provide these “as is” and without endorsement or warranty. Your use is at your own discretion and subject to those third parties’ terms and policies.


13) Relationship with Shopify

We use Shopify to power our store. Your purchase is with Nethergate, not Shopify. By using the Services, you acknowledge Shopify isn’t responsible for our sales or products and you release Shopify from claims arising from your transactions with us.


14) Intellectual Property

All content and materials on the Services (text, images, logos, trademarks, designs, and so on) are owned by Nethergate or our licensors. You may use the Services for personal, non-commercial purposes only. Don’t copy, modify, distribute, or exploit our content without written permission.


15) Reviews, Photos & Feedback

If you share reviews, photos, ideas or feedback (“Feedback”), you grant us a worldwide, royalty-free licence to use, share and display that content for operating and promoting the Services. You promise you own the rights, your Feedback is lawful, and you’ve disclosed any incentives. We may moderate or remove content at our discretion.


16) Prohibited Uses

Please use the Services lawfully and respectfully. Don’t: break the law; infringe IP; harass or harm; submit misleading, malicious or unlawful content; spam; scrape; bypass security; or interfere with others’ use of the Services. We may suspend or terminate access if these rules are broken.


17) Warranties & Our Liability

Except as required by law or expressly stated, the Services and products are provided “as is” and “as available.” We don’t promise uninterrupted, error-free access.

We warrant products are of satisfactory quality and fit for common purposes. Our total liability for losses arising from a contract with you is limited to the amount you paid for the relevant product(s). We’re not liable for indirect or consequential losses (e.g., loss of profits, business or data), except where we can’t limit or exclude liability by law (for example, for death or personal injury caused by our negligence, or for fraud).


18) Privacy

How we collect, use and protect your data is set out in our Privacy Policy. Because we use Shopify, some data is processed by Shopify and its sub-processors—see their privacy notices for details. By using the Services, you acknowledge these policies.


19) Errors, Typos & Changes

Sometimes mistakes happen. We may correct errors or update information (including pricing and availability) without prior notice. If a correction affects your order, we’ll contact you.


20) Termination

We may suspend or end your access to the Services at any time (for example, for breach of these Terms). You remain responsible for charges up to the date of termination. Sections that reasonably should survive termination do so (including IP, limitations, indemnities, and governing law).


21) Severability

If part of these Terms is found unlawful or unenforceable, the rest remains in effect.


22) Waiver & Entire Agreement

If we don’t enforce a right, it isn’t a waiver. These Terms, together with linked policies, are the entire agreement between us about the Services and replace prior understandings.


23) Assignment

You need our written consent to assign your rights under these Terms. We can assign or transfer our rights and obligations without notice.


24) Governing Law & Jurisdiction

These Terms and any disputes or claims (contractual or non-contractual) are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction.


25) Changes to These Terms

We may update these Terms from time to time. We’ll post the new version here and, where required by law, notify you of material changes. Your continued use of the Services after changes take effect means you accept the updated Terms.
